"Stepping back from the precipice in Bond"
The Scalia opinion is, to say the least, unpersuasive.
Just Security provides a good analysis of the Bond ruling here. Note the footnote. I repeatedly dealt with the other side when Rosenkranz et. al. badlydiscussed it at Volokh Conspiracy.
