Voting Matters etc.



Sibel Edmonds in her appearance on The Laura Flanders Show (Air America) over the weekend mentioned that an Inspector General report addressing some of her concerns would be classified. Senators Leahy and Grassley sent a letter asking that an unclassified version be publicly released.

Congress feels a need to hold hearings and a vote regarding a constitutional amendment (supported by the President, if not the second lady) against gay marriage. I have expressed my annoyance at Sen. Kerry not being able to accept the concept of gay marriage, though his record on gay rights has generally been very good. This including understanding federalizing discrimination is a bad thing. It is here where we can clearly see that this election is a question of values, and on what side one might wish to fall.

Meanwhile, the rights of millions of citizens to vote are currently being deprived, namely felons, including those who completed their sentence and parole. As Reynolds v. Sims noted: "Undoubtedly the right of suffrage is a fundamental matter in a free and democratic society. Especially since the right to exercise the franchise in a free and unimpaired manner is preservative of other basic civil and political rights, any alleged infringement of the right of citizens to vote must be carefully and meticulously scrutinized." Thus, I offer this discussion of a matter that might be a better use of Congress' time.

As to talk about postponing the election, Jack Balkin provides some interesting commentary. In general, it might be useful to have some contingency plan, but I surely wouldn't just empower the Department of Homeland Security to decide the matter.
