Gun Case
ScotusBlog and Volokh Conspiracy, see blogroll, are two good resources for today's oral argument in the D.C. gun case. Kennedy's pro-individual rights sentiments and Breyer's desire for some middle ground is a plus for the pro gun rights side; I was not sure how strong Kennedy (and all of the new conservatives) be on that point. Volokh's comment on the justices supporting a practical, not strictly originalist, view of the Second Amendment is on point but a bit ironic given the excessive originalist nature of the lower court opinion.
