SCOTUS Watch

Various notable orders, justice statements (e.g., Thomas on civil forfeitures) and decisions before SCOTUS returns just in time for the Gorsuch (boo!) hearings. The trans student bathroom case was remanded per the change in the executive's position. Breyer's "courtesy fifth" yet again seems misguided -- this was a case that should never have been taken at all. Decisions include a split (on reasoning) sentencing guideline/vagueness case and 5-3 jury case involving racial bias of jurors. Unclear if this will be cabined to race.

And Also: The new executive order on immigration very well is likely both bad policy and unconstitutional, but it is telling that they tempered it so much. Opposition had bite.
