SCOTUS Order Day

The Order List had a few inside baseball things.

A case was granted for review. The case was previously "relisted," flagging the justices were interested in it.  The Biden Administration also supported the review, opposing the opinion below that protected the right to the trademark in a case involving a Trump-related t-shirt.  Somewhat curious since it does seem like the opinion below was sound.

Gorsuch also noted he would have granted a reargument request. These requests are basically never granted. The case involves a civil fine, something he flagged (with Jackson, who didn't join him here) in a recent case.  The case had excessive fines concerns.  This is just a little inside baseball that flags his personal interest in the subject.  

The justices also (without any comment) rejected a stay of execution and cert. request involving an execution scheduled for tomorrow. I am supportive of not making these things last minute.  I am not supportive of these "no comment" final orders on the death penalty shadow docket.  I will provide a more extended discussion of the case tomorrow. 

BTW, nice that Chris Geidner's original blog had a 20th anniversary. My blog had one in May.  Since no one actually reads this blog, it is of less note.
