I am sympathetic with this reply to a (sadly typical) somewhat overboard post, especially when the oral historians themselves have a restrained reply to the controversy.

Yes, like when states recognize a reporter's privilege, the policy generally is to use a balancing test of some sort. I think -- especially since 49 of 50 states if I'm not mistaken has them -- some some of federal privilege there would make sense, but with the same sort of balancing. The oral historian society here seems to recognize the balance involved, so that's reassuring.
